Congress Abandons Critical Housing Programs -- Again

 

Realtors have been urging Congress to pass a comprehensive National Flood Insurance Program reform bill all year. We conducted a Call for Action in April, testified at Congressional hearings and urged action during our midyear hill visits. Yet once again, Congress left town before reauthorizing the NFIP and the Section 502 Rural Housing Program. As a result, thousands of transactions have come to a stop, again. 

 

The NFIP and the Section 502 Rural Housing Program are critically important to Americans and the U.S. economy. The real estate recovery can’t afford prolonged Congressional inaction. 

 

Regardless of your location, rebuilding our markets in every corner of America is in every Realtor's interest. The Realtor Party must speak with one voice to urge Congress to renew both NFIP and the Rural Housing 502 program today. Please contact Congress today.

Prevent New Tax Burdens on Real Estate

 

Congress is considering new tax proposals that would place additional burdens on owners and investors in residential and commercial real estate.

 

The real estate industry is still very fragile and likely to remain so. In better times, the real estate industry would be a dynamic engine of job creation. Any new tax burdens on real estate owners will impair and delay further recovery. These proposals are ill-advised, inopportune and potentially destructive. Please take action today to tell Congress "No New Real Estate Tax Burdens".

Call Your Senators Today to Urge Vote on Tax Credit

 

Dear Jennifer,

 

Thank you for your continued support to Expand and Extend the Homebuyer Tax Credit.

 

We need to ask for your help one more time. Please make a quick call to your Senator's office to ask for cloture on the Unemployment Insurance Extension bill that contains the tax credit provision. This cloture vote is scheduled for Monday evening. Sixty Senators must vote yes so that a vote can be scheduled on the tax credit.

 

The vote is on Monday at 5 PM. So if you make the call this weekend, leave a voicemail with the provided talking points. Otherwise, save this email and make the call first thing on Monday morning in order to speak to a member of the Senator's staff.

 

This call is important. The tax credit will not get voted on unless we can get past this critical legislative procedure. All you need to say once you are connected:

 

> I am a constituent and a REALTOR®.

> Please vote YES on the motion to invoke cloture on the Unemployment Insurance Extension.  

> Thank you for helping to ensure the ongoing recovery of the housing market. As a member of the National Association of REALTORS®, I appreciate your support to expand and extend the tax credit.

 

The $8000 first-time homebuyer tax credit will end soon. The housing market is stabilizing and improving, but the housing market crisis won't end this year. We can't wait until late in the year to see what happens.

Extend and Expand the Homebuyers Tax Credit

 

Dear Congresspersons and Senators,

 

As a Realtor and a Constituent, I can assure you that the $8,000 First-Time Homebuyer Tax Credit has definitely been a success. Homebuyer interest and housing sales increased almost as soon as the ink was dry on the tax credit legislation. Today’s lower prices and interest rates appeal to consumers, but it’s been the tax credit that has attracted people to open houses and to homeownership.

That progress could grind to a halt sooner than you think. Congress must act NOW to extend the credit through 2010. Otherwise, uncertainty will return and the market might again be frozen -- possibly as soon as October.

A homebuyer is eligible for the tax credit only if the home is “purchased” before December 1, 2009. That means that buyers have to find a house, complete a contract, satisfy any contingencies, secure financing and go to closing by November 30. Accomplishing those tasks by November 30 will become more difficult with every passing day. In today's market, it generally takes between 45 and 60 days to go from contract to closing.

The market has improved, but it has not yet fully corrected itself. The credit needs to be extended for an additional period of time and expanded in order to build upon the progress that's been made. Uncertainty about the future of the credit will dampen consumer demand. The best way to assure continued housing activity is to extend and expand the credit and to do that NOW.

 

We can’t wait until late in the year to see what happens. Consumers will drop out soon if they can’t predict what's in their future. Please act NOW to extend and expand the credit through 2010.

Thank Them for Their Service

The news these days is all about the economy. All day, every day. It overwhelms us. One unfortunate side effect of this is that lots of other items that would normally receive our attention are pushed to the back pages, if they are covered at all.

 

One of those back page items is coverage of our troops in Iraq and Afghanistan. That's too bad.

During the past few years, regardless of where one stood on our military involvements, there has been a near unanimous outpouring of support and appreciation for our military. Those expressions of support, I fear, are occurring less frequently as so many are focused on worries about their job, their homes, and vanishing retirement funds.

 

But we owe those servicemen and women no less now than we did when homes were appreciating and loans were plentiful.

 

A few years ago my wife and I were riding on a bus with a group of people who were the beneficiaries of what we called a "political event." It was sponsored by a state legislator. We were going to a ball game. On the bus was a person who was employed by a large, well known, California company. He was, essentially, a lobbyist.

 

We heard him chatting with people around him about some of his experiences as a pilot stationed on an aircraft carrier. Later, after the talk had died down, we asked him about his experiences. He was a naval aviator during the Vietnam War. We thanked him for his service.

 

He told us that we were only the second persons who had ever said that to him. The first was a South Vietnamese woman whose parents had immigrated to the United States. She was now working in a government-related job in Sacramento. Her family had lost everything in the war. She thanked him for what he had done and what he had made possible for her.

 

So what does all this have to do with real estate? Everything. In up markets and down, we still enjoy the right to own private property. There is still an American dream. There is a dream of home ownership, of getting ahead, and of making a future for the next generation. We're in a rough patch right now; but the dream is still there and still being realized in millions of lives. That dream is secure, because, all around the world, young men and women are standing on a wall. They are putting their lives on the line to defend our country and our dreams. They are there because of the dream; and it endures because they are there.

 

Does what these people do actually mean anything to any of us? Ask Richard Phillips, Captain of the Mersk Alabama.

 

I hope the young men and women who wear the uniform won't have to wait as long as our friend did before they hear a word of thanks. Please – walking down the sidewalk, waiting at an airport, shopping at the grocery store – if you have the opportunity, thank them for their service.

Oppose SB 361 - MD's Current Lead Paint Law is ALREADY Working!

 

Dear Jennifer Klarman,

 

With only days of Session left, legislation is moving quickly.  We NOW need your help regarding costly changes to Maryland's already effective Lead Paint Law. Please contact your Senators and tell them to OPPOSE Senate Bill 361.

 

Senate Bill 361 requires additional tests to be conducted on rental property subject to the Lead Paint Poisoning Prevention law. This change will add hundreds of dollars of costs to many rental units built before 1950 and many units built before 1978.

 

With the significant attention focused on affordable housing, new costs should not be passed onto ALL landlords and tenants - even those in compliance, particularly in light of the program’s incredible success.

 

Over the last 15 years, the number of children with blood lead levels that exceed dangerous limits has decreased from almost 24% in 1993 to LESS THAN ONE PERCENT in 2007, 0.8%. This reduction STILL occurred even when the trigger level test for elevated blood lead levels was lowered and the number of children tested was doubled.  

 

The law is working and instead of passing new costs on to ALL landlords and tenants - even those in compliance - the General Assembly should focus on negligent landlords who are NOT in compliance.

As you know, the onerous Septic Bill (SB 554/HB 176) passed the Senate narrowly by only one vote. We share the concern and work for a cleaner bay through fair legislation; however, we believe it should not be at the devastating expense of homeowners on septic in the critical areas! 

 

Contrary to the assumption that most waterfront and waterview homes are "McMansions" and can absorb the potential costs of over $12,000 for Nitrogen Reducing Technology - this could be financially devastating to most homeowners in the critical areas.  Consistent with the argument that the Bay is for ALL Marylanders, this disproportionate burden should not be saddled on select homeowners, who - like many of us - are struggling with this economy.

Oppose HB 1053 - Enironmental Standing Bill

We need YOUR help TODAY! 

 

The Maryland Association of REALTORS opposes legislation that would significantly expand legal standing in environmental decisions in Maryland when environmental permits are required (SB 824/HB 1053).  Basically meaning, someone’s legal ability to challenge numerous types of environmental permits.  This legislation not only broadens standing significantly, it also awards attorney fees, enables citizen suits as well as contested cases.  If passed, this bill would severely impact many development projects which directly and indirectly impacts REALTORS and homeowners alike, especially given our marketable product is real estate – improved and unimproved.

Anne Arundel County Revises Its Land Use and Zoning Plans

All Realtors®: Your clients can be negatively affected, or benefit from, impending zoning changes!

 

Every 10 years, Anne Arundel County revises its land use and zoning plans. Changing what happens after this year will be far more difficult than it will be this year. THE COUNTY'S GENERAL DEVELOPMENT PLAN MEETINGS ARE OVER. If you did not make one, then the next opportunity to have some say will be when hearings start at the Planning Advisory Board.

 

Attend a free informational seminar by one of the association's affiliate members on how to affect the outcome of the zoning process to benefit your clients.

 

Either way, please try to keep up with the process for your clients.  This is the one year in ten that zoning changes are made through the countywide planning process (comprehensive rezoning).  Consumers frequently expect their Realtor® to be up to speed on these kinds of land use issues.

Delegate Costa Sponsors Bill to Control Utility Costs and Late Fees

 

Annapolis – Delegate Robert A. Costa, R-33B – Anne Arundel County, is sponsoring Legislations ANNAPOLIS – Delegate Robert A. Costa, R-33B – Anne Arundel County, is sponsoring Legislations entitled “Public Utility Companies - Gas, Electric, and Telephone Companies – Billing Practices”– HB 766. This proposed legislation will require gas, electric, and telephone companies to bill residential customers once every billing period, subject to specified exceptions; requiring that the due date for a monthly bill issued by a telephone company to a residential customer be at least a specified number of days after the date on which the bill is issued.

 

The bill was introduced on February 11, 2009 and is scheduled for a hearing in the Economic Matters Committee on February 26, 2009 at 1:00 p.m. All those interested in the legislation are invited to the public hearing and encourage to testify with Delegate Costa on the legislations behalf.

 

“Maryland citizens should not have to continue to pay late fees on their telephone and electric bills just because they get billed faster then they get paid”, stated Delegate Costa.

 

Delegate Costa represents District 33B in Anne Arundel County and is serving his second term as a member of the General Assembly. He is a member of the House Health and Government Operations Committee. The Health & Government Operations Committee considers legislation related to Health Occupations, Health Facilities, Public Health, Long Term Care, Government Operations, Health Insurance and Minority Health Disparities.

 

Delegate Costa represents a single member district with includes the communities of Sherwood Forest south through Davidsonville to the Anne Arundel County, Calvert County border.
